Terms of sale
Working draft, to be reviewed by a lawyer before going live. This page lists what the final text has to cover. It is not a valid set of terms of sale.
Returns on a made-to-order item
Twój produkt powstaje na zamówienie, z Twoich zdjęć i Twojej konfiguracji, więc nie można go zwrócić po rozpoczęciu produkcji. Do momentu zatwierdzenia projektu otrzymasz pełny zwrot pieniędzy.
You see this again at checkout, before you pay, and you acknowledge it yourself:
“Rozumiem, że produktu na zamówienie nie można zwrócić po rozpoczęciu produkcji oraz że do momentu zatwierdzenia projektu przysługuje mi pełny zwrot pieniędzy.”
The final text has to carry the exception in these exact words, and spell out the refund procedure that applies before you approve the render. TODO: cite the statute it comes from, market by market. Every European market transposes the same directive under its own article number, and a lawyer has to say what a US buyer is owed instead.
Scope and acceptance
Says who these terms bind, and from when. The final text has to be accepted explicitly at checkout, before you pay.
Products and prices
Custom figurines, modeled from your photos and made to order. Prices are shown in the currency of the market you are browsing, tax included. TODO: name the price-display and tax rule for each market we sell in. The European rule and the US one are not the same, and a lawyer has to write both.
Ordering and approving the render
Walks through the order: after you pay, a 3D render goes out for your approval before anything prints. 2 revision rounds are included. The final text has to carry the rule the rest of the site states: “Jeśli nie odezwiesz się w ciągu 48 godzin od wysłania renderu, produkcja rusza z zaproponowaną przez nas wersją.”
Payment
Which payment methods we accept, when you are charged, and what happens to a declined or disputed payment.
Production and delivery times
Production takes 7 business days once you approve the render (4 business days with the express option), then 3 to 5 days of tracked transit. Shipping is free over 79 €. The final text has to say whether these are commitments or estimates, and what happens when we are late.
Defects and reprints
What you are entitled to when a figurine arrives broken, or clearly different from the render you approved: a free reprint, how to ask for one, and by when.
Liability
The limits of our liability, including what the likeness guarantee covers and what it does not.
Rights to the photos you send
You warrant that you hold the rights to the photos you send. An order that depicts a protected character is declined and refunded. The final text has to say who carries the risk if someone else complains.
Governing law and disputes
TODO: name the governing law, the competent courts, and the consumer dispute-resolution scheme required in each market we sell in. This draft leaves it blank on purpose: a wrong jurisdiction here is the most expensive clause on the site.
